This concept should be extended to IT as well
How much more would innovation be served if it were freed of the 'threat' of lawsuits from those speculative companies who 'mine' 'traditional' IT concepts? Microsoft has literally thousands of patents and is 'lying in wait' to nail the first set of deep pockets that might (unknowingly) venture into MS's turf. Other firms have been built around the sole 'service' of buying up (making up!) patents, then sitting on them until another party (like RIM/Blackberry) has, through substantial research and investment, built a tremendously successful enterprise, only to then be slapped with infringement suits.
