CAN-SPAM requirements
I believe the intent of the act was to allow businesses to send transactional messages (like a shipping notice, or confirmation of a booking), etc. and that such messaeges were therefore exempt from the CAN-SPAM requirements. So such messages could contain other advertisements or deals etc. and such messages do not have to include opt-out or remove instructions.
However, I do not think this allows the business to send future messages (not confirmations) that contain coupons or deals - those follow-on messages are advertisements and should follow the CAN-SPAM requirements.
