Suing is ridiculous
Realistically, no lawyer would touch that case. Even with some punitive damages the case is worth maybe $600-800 tops. A lawyer will send a few threatening letters and maybe get a refund, but sue? No way! Just the fees for an expert witness would be in the $3,000-5,000 range minimum. Court reporters' fees to take a deposition start at around $300, depending on the length of the number of pages. Two experts' depos and two fact witness depos would easily be $1,500-2,000 just for the court reporter alone.
