Is this is solicitation really "unrelated"?
The legal wording says "unrelated" marketing. Continuing your IP-based phone service since yours had been shut down due to the provider going out of business would be considered as "related marketing", IMHO. If the names were sold or traded to Disney for marketing purposes, then I would say, that THAT marketing is "unrelated". I think this will hinge on what a court would consider "unrelated" verses "related". The second thought is whether Sherwood is required, as a liquidator, to adhere to all the same privacy provisions as promised to the customer by the company its liquidating. As a consumer, we would hope so. But a liquidator may not think so. I am sure they would do some due diligence and ensure they were not blatantly allowing the private information to get into the hands of just anyone. But selling, trading the names and addresses to a competitor, that could potentially continue to provide the same or better level of service, and is in the same industry, I would think would be within their right as a liquidator. Names and addresses are sold every day and not really considered private. Other Personally Identifiable Information (PII) data such as SSN, DOB, Marital Status, income level, number of children, sex, email address, etc. ARE still generally considered private and generally are not released without permission. Again, Sherwood may assume (correctly or incorrectly) that they are not bound by any privacy provision. Only time will tell.
