Business as Usual
A few things:

Novell isn't as 'cozy' with MS as their covenant and inter-op agreements suggest.

They are actively engaged in an Antitrust suit against MS

I personally don't believe for a minute that MS is interested in open source; the device driver code provides 'hooks' into MS Windows Server 2008 for virtualization.

MS has made innuendo that they have approx. 230 patents that Linux infringes upon. They have not shown one line of code thus far.

In re Bilski makes potentially 'many' of MS' Business Method Patents 'worthless'.

In the meantime, it's 'business as usual' for Novell.

Footnote: Red Hat is now on the Standard & Poor's 500 Index as of today.
