Licenses allow one to use Copyrighted works.
If you are not following some license when using works protected under Copyright, you are infringing on said Copyright holders (owners) rights. Copyrights are used to protect software that is both commercial (Microsoft, Oracle, etc.) and that released under the umbrella of Open Source (BSD, GPL, Apache, etc.). In order to use said software, you agree to the applicable license. If you do not agree to the applicable license and market/sell a product that infringes on said license, you are in violation of Copyright Law (Intellectual Property Law) which exists and in enforced in most countries (even Australia). It is pretty simple.
