They are hosed.
They have no leg to stand on, and obviously, they are using GPLed software with proprietary methods that they don't want to disclose. Since the long term relief is simply that they must stop using BusyBox or release the full source code, the delay is probably so that they can scramble with a plan-B. In the enterprise, anything that gives you a competitive advantage is closely guarded. Shame that they wanted to have their cake and eat it too (ride the backs of other developers work to enhance their market position)

Hopefully, the injunctive relief comes soon. I had thought that the plaintiff could ask for an injunction right away, based on the apparent merits of the case.

And before any GPL fudsters start in with the evil that is the GPL, don't use any. Write your own code, do it all yourself, no problem. What do you mean you want to appropriate the code and make money off other peoples work?
