Theres that loophole again....
....that doesn't exist. I dislike the idea of the ASP loophole. Its not a loophole. Its a change in principle thats causing the problem if you ask me. The idea of FOSS was software you could do whatever you want with...as long as you don't sell it.

Allowing someone to use your software is not the same as distributing it. Someone tried to argue with me that you have to pay to use proprietary software but that isn't true. You have to pay to INSTALL proprietary software. I can go over to someones house and use their copy of proprietary software...I just can't take a copy with me and install it. That would be distribution.

Now who is going to tailor an application to their internal need, the true benefit of open source, if they have to release information about the inner workings of their company. I just spent a long time explaining how you didn't have to reveal your code to an anti-FOSS friend of mine and here comes this AGPL basically confirming every single fear he had about using FOSS. Its about as much good as proprietary software with the AGPL tagged on.

The "ASP loophole" is nothing more than jealousy of big companies having found a way to use the software as intended for profit. Now some in the FOSS community seem to want to go back on the idea of freedom and demand to see the changes you make. This is a restriction...not a freedom. You are supposed to be free to share your changes...not required. If you want to see FOSS die in terms of commercial adoption just stick the AGPL on some prominent projects.
