I wonder...
Trademarks are tricky. You don't have to go thru formal trademark process to 'own' a trademark. As long as you use the "TM" and can show first use, you are covered by common law protection. Of course, once you are in court, things can get messy. The law does allow for some limited protection for those who have not formally processed a trademark claim. Typically, when you see the "R" with a circle around it, it has been formally trademarked.
