- Only stays relevant if you use the stock earphones

These kinds of volume level restrictions only work if you stick with the stock earphones provided with the MP3 player. Switch to aftermarket earphones that are more efficient and you'll get a louder default maximum volume. Switch to aftermarket earphones that are less efficient and the maximum volume will be less (sometimes much less).
These kinds of volume restrictions also fall apart if you listen to music that is softer in volume (like most classical music). Not everything is recorded as loud as Metallica.
At least the current EC proposal allows for the user to override the default maximum volume after getting a warning. That way people will still be able to use headphones that sound better but happen to be less efficient.
One problem is that most people don't know what 80 dB music sounds like on headphones. It is very difficult for a normal person to measure what the actual dB level is they are listening to. So how is a normal person to know? If people buy an aftermarket earphone that is more efficient than the stock earphone are they going to assume that the maximum volume level is still safe? The warning and the government probably said it was.
