releasing the identity to the plaintiff is fair and necessary, otherwise you have no recourse.

I will take issue with one statement however. You wrote "After all, it?s protected free speech to say that you believe someone is disingenuous or otherwise intolerable. It?s another thing to imply incorrectly that the person sleeps around, especially if you knew it wasn?t true."

"Especially if know knew it wasn't true" is a bad standard. If you libel/slander a relative stranger, you cannot know that something is NOT true. Proving a negative is often also impossible. The test I believe, is whether it IS true. If you know that it IS true (and can prove it), it can never be libelous/slanderous. Otherwise, keep your mouth shut so to speak.
