Much hangs in the balance
Congress has tried to protect service providers with two laws: Section 512 of the DMCA which provides "safe harbor" for providers from users who upload copyright content; and Section 230 of the Communications Decency Act which again, provides blanket protection for providers from the activity of it's users.

The only two issues I can see in play are what YouTube "knew." If the defendants can show YouTube "knew" about the violations and did nothing, then they're in trouble. On the other hand, if YouTube can show it tried, albeit imperfectly to remove copyright material, they should be OK.

For myself, I hope the Judge respects the laws designed to prevent these suits more than political pressure.
