RE: Judge's idea to outlaw links won't save newspapers
Speaking as a lawyer--the judge's comment just goes to show how out of touch the legal system is with the realities of how people live their lives and conduct business today. For instance, there is still a strong emphasis on paper documentation of transactions, etc. Granted, it's pretty easy for someone with even just a little tech savvy to create authentic-looking images of non-existent documents, and printing the images eliminates clues like minor shading differences. But the reality is that to a large extent the American legal system is still in the late 19th Century in its expectations and approaches. The result is that problems that should be addressed by the legal system (e.g., Microsoft's monopolistic practices) wind up being settled by the marketplace, based not on fairness and public interests, but on who has the most financial clout.
