Would be pathetic to do so
That would be low from even Apple to do so though this wouldn't surprise me. However this could show that Palm is the first to really worry Apple Smartphone wise. It could be interesting to see if Palm will be able to design several Smartphones as impressive as the Pre,compatible enough to enable applications to work alike on them while being different enough to address the needs of significantly different users.

BTW,this whole patent thing is really becoming annoying.
One should be able to patent their specific implementation of a functionality but should be forbidden to patent the called functionality as this could only be hurting the competition. Especially if a company implementation is so ahead of competitors than almost noone can reach a similar level of implementation.
