We've been dealing with this test for 2 years
This new legal test is nothing new, but it won't kill software or business method patents. It merely moves to boundary a little bit inwards... but the U.S. Patent Office has been applying this test anyway. Claims to patents must be tied to or manipulate some structure, but even then, there are cases which have been allowed and referred to in this CAFC case which don't appear to meet this less permissive test, but have been allowed.
