Linus would have a difficult time moving the kernel to GPLv3. Many kernel devs have already 'nixed' the idea and Linus, unlike the FSF does not hold the copyrights on all kernel contributions.

Since it's been ruled that UNIX is owned by Novell and Sun may not have had proper authorization to 'open source' Solaris, Novell may have an issue with Sun. Especially if Sun attempts to license Solaris under GPLv3 considering Novell's patent covenant with Microsoft may make that license problematic for Novell.

ZFS moving to the GPL is a possibility.
