USPTO to give MS chance to remove EOLAS patent.
Microsoft will get a chance to convince the US Patent and Trademark Office that a patent for web browser plug-ins held by Eolas Technologies should be overturned. The dispute between the two companies dates back to 1999, when Eolas sued Microsoft over its implementation of ActiveX, saying that it violated a patent granted to researcher Michael Doyle of the University of
California.

According to Bloomberg News, the USPTO has decided to give Microsoft a shot at arguing that it was first to invent the technology named in the patent. With the US patent system using a first-to-invent model rather than the first-to-file model common in other countries, a finding that Microsoft did
indeed invent the technology would invalidate Eolas' patent, leaving Microsoft in the clear.
