As for the triple damages. If there was a countersuit they would get it. And yes it's only a subpoena. if it was a lawsuit and that apple wished to shut down the website, then damages from being wrong could be in the works.

However, still being a subpoena, if Apple loses, they may be liable for costs and any losses from court action (that means revenue, if you can prove losses). At least that is the way in our country. In our country the loser pays and pays in triple damages if found to be fivolous, wasting courts time or malicious.


Does the friend he told it to oblige, to tell you who told him? no!... he could even lie to you too or say I don't remember who.

Only the friend can be fined/sued (if you can prove it), and if your other friend says he can't remember who told him, you have no case.


The key here is also Trade Secret Protection laws, No NDA should be allowed if it goes beyond trade Secret protection laws. Otherwise it may be a violation if you tell someone another employee's name (even by accident). That being said any NDA that goes beyond that ceiling should be made invalid. Meaning if the information is not highly technical (real IP info like code,schematics, ingrediaent, chemicals, processes) you have no case. That doesn't however stop you from firing the person on other grounds.
