Problem with that is judges are known to be wrong from time to time
That is why there is a supreme court. Just because one lone judge makes a ruling (in apparent error of supreme court rulings of the past in protecting the free press) doesn't mean that apple will win or has the right to go after them. This will be a test bed to see whether rights that are granted to the press are granted fully to those posting on the web.

I suspect it will go to the supreme court and the ACLU will get involved as well.

The supreme court is the final judgement of the case. It's will be them that will determine if Apple (and the initial judge was right). That's if it makes it that far, the appealate court may overrule and kill it beforehand. Then it's up to Apple if they wish to push the justices on the point. And if they lose they could wind up paying damages to the website/press they went after. After all Apple cost them money, when they had no legal grounds to do so (and it could be in triple damages).

Sometimes it's just better to shut up and live with the outcome of the apparent early press devulgement of your product. It's life, No company and No one person has protection rights that business (non-IP information - that means technical and financial would be protected, everything else is fair game) or personal information cannot be leaked, or made public. That is life. You can't keep secrets forever. Should you be able to sue your friend if he tells personal information (an embarassing moment in your life) to someone else. NO. did it do harm yes, is it libeleous, no.

The thing is that if Apple would have dealt with this issue with more tact, and not sued (you could have made a deal with the websites, gave them an inside view of product developement and early info for sign NDA'a, and press release would be first passed by Apple's CEO. in exchange Apple could offer $$ and the sites get the early press release of new products.

Instead they are getting worse press than if they had left the thing alone. Meaning that Apple has done more harm to itself by following this route than accepting the fact they have a leak, they need to deal with it internally. or it will happen again regardless if they get any info from the websites.

Bad press is Bad press. The more it lingers on the worse it looks for Apple.
