I don't think so, rhavyn.

I think it probably falls more under the category of the old "selling up" technique; a tried, true AND legal way of pumping up sales. Like Spooner has said here in the posts to this article, Dell has the exact PC's in stock that they're advertising, and for that price. They just "sell them up" (adding different features, freebees, etc.) differently depending upon when you have logged into the site.

I think it is going to be REALLY hard to convict them of bait-and-switch since --- as Spooner has also said --- it will come down to the classic point of "let the buyer beware."
