They advertise a low price then don't have the product to sell you but try to convince you buy the next model up.

By law they MUST have a "quantity" available to sell at that price. If they are out, as you said, then they can legally try to convince you buy the next model up, they are not putting a gun to anyones head. This is very common business practice, you may call it "shadey", but it is business. Just watch any TV ad for those "super sales" at football stadiums and such. The ads are loaded with "computers $10, "laptops $18, "tennis shoes 5 cents, etc. As long as they do have some of the items advertised, then it IS legal.

Did we forget about the motto "buyer beware"? It is a good one.
