I don't believe that has happened here
This is a common technique used in sales. You have a limited supply of the less expensive models, someone inquires about the cheaper model that you might be out of, and you direct the consumer towards what you DO have available (nOT illegal at all). It is then up to the consumer to make an intelligent decision (oops, these consumers are out of luck), no one is pulling the money out of their pockets. There doesn't seem to be any fraud here at all, but it is california, so we''ll have to wait and see how the ruling goes. The rulings out there don't often make sense.
