But what if by telling anyone, you are revealing a state secret, one that endangers the life of a public servant, in essence, committing treason? Obviously the source in a story like that (the so far unnamed White House official) has committed treason. But by spreading the information publicly, can the reporter also be accused of acting in a treasonous fashion? Without the widespread media reports, the CIA agent's life is not endangered.

As another example, what about the DeCSS code? Let's say you weren't the one who created the code, but by disseminating it, are you guilty of violating the DMCA?
