Apple tried and failed to do this under the radar...
Based on the article, Apple tried several times to contact 'Think Secret' and get them to remove the content and turn over the tipster(s). They (Think Secret) never responded to Apple's requests, thus the lawsuit.

One, a secret is a secret. whether you think it should be or not is not relevent. If you are told it is secret, then keep it secret. A moral person would not repeat secrets unless there is a higher responsiblity (someone's life is in danger, protecting your country and things like that). But not corporate secrets; especially if that is your bread and butter.

Two, they have non-disclosure agreements. What is the point of contracts if they cannot be enforced. If you are running a company with employees that are what amounts to be are spies; you have to do something to protect your interests. Loose lips sinks ships as they used to say. One word about something slips to a competitor like Microsoft, and you could lose your advantage to being the first to market.
