RE: consumer who wants a backup a criminal
I wonder how many consumers actively make backups of the CD/DVD's they purchase? For that matter how many people create CD/DVD's from their existing VHS collection? The process is so slow that most consumers buy/rent or borrow their entertainment and that is that. I know that technology is advancing to a point where recording is getting faster but most people do not do that.

I will say this, DRM seems to me to be a rather large cannon used to stop a few people from true illegal copying and distributing. I also believe that DRM is a problem for folks like you that do backup their movies and that is not right.
