The problem in your argument.
"Today, the CE companies are agreeing to participate in secret consortia where a maximum threshold for functionality is being set out by the studios. The CE companies are promised that if they play within the cartel's rules -- i.e., if they don't ship the products their customers want -- then the cartel will sue into oblivion any competitor who enters the market with a more-capable device."

The IP owners have EVERY right to decide what to do with thier property and how it may or may not be distributed. If they place restrictions on the use of THEIR PROPERTY, that is their right. You suggest that the hardware/software folks are afraid of a legal suit, I would say the bigger problem is they will be denied access to the IP owners property. Which of course is true and as it should be.

If I made a product and signed up distributors, I would be the one to decide how that distribution will work. Any distributor that disagrees is free to find someone elses product to distribute. See how simple that is???
