According to the article
Apple applied for the patent in June 2003 and IBM started shipping it on the Thinkpad in October 2003. So that would mean Apple applied for the patent before IBM started shipping product. The missing bit of information here is how long IBM was developing the technology before releasing it.

Sounds like there may be prior art.
