Short term "fix" for what's not broken for the consumer
Whether using a hack, a mod, add-ons from independents or Real, whomever, Apple may face an uphill battle on treatment of what consumers do with a product after its sold (the iPod), and the iTunes as a evolving service.

Apple may have contractual obligations to fulfill with disabling after market products, but those consumers desiring to use will not be bound by those obligations (at least those who forgo the restricted upgrades and/or warranties). This little EULA may become a much discussed and disgusted piece of legalese.

Seems more like a win situation for the hacker who?ll just see the latest Apple fixes as something to unfix, maybe even expand or redirect to other services, and that's the tricky part, making the mod as popular as the product can lend life, if not malice to the attempts. Next thing you know, somebody will be running Linux on the thing, or emulating their PS2 on the new Photo iPod.
