MP3 isn't open either.
It's patented and requires licensing fees for each encoder and decoder sold. They also tried to enforce separate licensing fees for each use of the encoder (read: for every MP3 file ever made).

Ogg Vorbis is the only viable open lossy audio codec standard at this time, and it is technically superior to MP3, MPEG4 AAC, WMA (at least through WMA9), RealAudio (at least through Real9), Q-Design QMusic 2 (the best audio codec that comes with QuickTime 6+) to boot. It gives better sound at the same bitrates, or smaller bitrates at the same audio quality, or both, compared to any of those.
