Spyware
We do not need legislation to control spyware. What we do need is and open source software soloution that checks information for spyware as it comes in. Even if they could, the US government should not be policing the Internet.

The only legislation I might agree to is the requirement that software compaines inform the person down loading the software that spyware is on board. Let the user decide, not the goverment.
