It's just more free publicity!
First of all, if the game has been release to viewers, there is absolutely no reason why the judge can't also review it. If the game was still shrouded in secrecy, I'd say the courts have no right to preview the material, but it's already been out there and reviewed by large national entities.

Secondly, it's a game people. Should we limit some games to adults? Sure, why not? We limit some movies, magazines and websites, so I don't see that as any great rights infringement. But should we ban adults from playing any game they want? No, why would we?
