---Guess most didn't know Creative's patents were filed before Apple release the IPOD.---

Correct, filed before the iPod, granted after the iPod, so it should be considered valid.

This is where I have a problem. Yes, they do have the right to sue because of this patent, but in my opinion, it's a bad patent, one that won't hold up. Hierarchical display systems have been in place since the Apple Lisa. I expect prior art to come into play, to see this patent re-examined, and get thrown out.
