Still is a civil matter
It's still a civil matter. Criminal law is on the books in statutes. A contract can not add to that no matter what the wording. If you break the law you can be charged independantly of the contract. All the contract does it allow the contractual party to sue you for violating the contract. If crimes occured in violating the contract they prosecuted under the criminal law not the contract.

Also as for contracts. I break them all the time. I currently have contract with my Telco for 2 years. I'm actually considering breaking that contract. It will cost me $50 to do so. I see nothing immoral about doing so. I'll pay the price as defined in the contract.

If you want to break a contract be aware of the price. Breaking an NDA for example comes with a very high price and can ruin you. Doing so may not be in your best interest.
