because now the litigation fees will be passed to customers, along with possibly higher license fees if they are in a bind. Lets also not forget that Lucent is asking for an injunction, which if granted and not suspended awaiting appeal, would effectively pull all 360s off the shelf.

If there's even a moderate chance they could loose the lawsuit, they really have no choice but to license. MS is gonna eat the cost of it anyways. There's no way their going to raise the price another $20 when their already subsidizing so much of the cost. Don't forget the business model is to lose money on the console and make up the difference and profit on the games.
