No, Americans are getting fatter. This is like suing McDonalds before Americans got fatter, because maybe there was the potential for Americans to get fatter someday, and maybe McDonalds might have something to do with it.

This whole lawsuit is not about hearing loss, it's about the possibility of hearing loss. How much money should you receive in damages for something that hasn't actually happened to you?
