Greedy lawyers
When the Sony Walkman was all the rage in the 80s, doctors
were saying the exact same thing then. Loud volume = hearing
loss. And when the Sony Discman was all the rage in the 90s, it
was exactly the same message. Some people like it loud and it's
up to people to exercise good judgement. And when you go to
a concert, you expect to either bring ear protection or go deaf. I
don't see people suing concert promoters for not keeping their
loud speakers under 90db.

Should we limit all concerts to 90db the way people are saying
headphones should be limited? How about cheering at a
ballgame? Or what about limiting jet and combustion engine
sounds, fog horns, or sirens for that matter to no more than
90db so we preserve our hearing?

Some lawyer somewhere is looking for a big payday by going
after frivilous crap like this. In class action suits like this
everybody loses except the lawyer. What's worse the consumers
get shafted twice. Once for the ridiculously pointless and low
value settlement and again when the prices for our audio
equipment goes up to cover the expense of this nonesense.

Anyone who has ever purchased an audio device knows that
there are warnings about excessive volume printed
EVERYWHERE. You'd have to be illiterate or not watch any news
over the past 30 years to not know.

The way I look at it it's an individual's right not to exercise good
judgement and do something stupid. But those of us who read
our packages and make good choices shouldn't have to pay for
the poor judgement of others.

Cases like these should be thrown out on the grounds that it's
common knowledge. It's like suing auto manufacturers because
you can get hurt or killed when driving a car. It's not the car, or
the audio player stupid, it's how you use it.
