Depending on which way the court battle goes depends on if the plaintiff or defendant can go for appeal. Further the courts also have some say. To say only the patent holder(in this case NTP) has anything to say in the appeal process is so far out of whack from the reality of the situation, Im not even sure what you might of ment by that if Im just not understanding your point or something.
