I agree in part...
?that NTP seems to be primarily a patent holding company. I'm not sure why, in and of itself, that this is looked upon as a bad thing. But I'm primarily interested in your source of information when you state that the company owner is 'now dead.' Is NTP publicly traded? If so, it seems reasonable that its shareholders are now the company ?owners? - and therefore, have the right to profit from the production of a product incorporating technology it holds patent rights to.
Nevertheless it seems the NTP is loosing the battle at the US patent office; 2 of its 5 claims have been invalidated by preliminary final rulings of the Office. The most interesting (to me) scenario would be that NTPs claims to patent rights over technology used by RIM, be at least partially upheld. That would bring to focus the real issue; a patent process that grants rights to an inventor, only to have the Office later say essentially? OOPS!
The system is flawed to the point of utter insecurity. A patent granted means absolutely nothing until it survives one or more court battles. That clearly isn?t what United States patent law was designed to provide. It shouldn?t be the level of service that patent applicants expect from the Office.
