What System Is Broken
There is a lot of opinion floating around about how the patent system is broke, and what has to be done to fix it.

The root cause is what has to be fixed. Which is a glaring but not mentioned conflict of interest, and unrestrained greed in the legal system.

You have all the lawyers advertising to the inventors, or working for the corporations, saying "COME TO ME" and I will file your invention at the patent office for a "LARGE FEE". Of course I will not research the originality of your invention, or the associated prior art, but instead I will lead you to believe that you have substantial right to patent.

Then when either you try to assert your patent against a perceived infringer, or the validity you patent is challenged, guess who is right there again for another "LARGE FEE", to help you defend your position. Does no one see that this is a conflict of interest and blatantly unethical. That the legal system owns the problem in the first place, because they most likely created it, and then they again want to charge you to fix it.

This is a lot like MS operating system, with all its security flaws, and MS developing some security program add ons, and now there is a dilemma of should we charge for these or shouldn't we? Well that all depends on how ethical that you are Bill, and the same goes for the legal system. The root cause is improper balancing of ethics and greed.
