I agree that some system like this is eventually going to be put
in place. But that doesn't mean it will be accepted, or used, or
make any difference whatsoever.

People who want to find a way around it will do so. Only honest
people will be inconvenienced and charged more. The question
is when does that inconvenience become enough that
consumers actively stop using/purchasing a product? We'll have
to wait and see on this one, but certainly, the massive drop in
sales for Sony's rootkit cds is an indication that it is indeed
possible to go too far, and that there are consequences.

I also think we're going to see more and more of a backlash
against legislators who allow themselves to be purchased like
this. Why is a senator from Alaska pimping a bill that hurts his
own constituents and helps rich people in California? Obvious
answer is that he's received over $381,000 from the
entertainment industry. In the age of Abramoff, this is a
dangerous path for an elected official to tread. Take a look at
what happened in Canada to Sam Bulte, once it was revealed
that she accepted bribes from the entertainment industry to
tailor copyright legislation to their whims:
