Just don't rely on the courts every time
Because, as can be seen at http://www.duiblog.com/
2004/11/01#a31, the Supreme Court of California has ruled that
scientific evidence isn't relevant. In the case of drunk driving, the
deck is already stacked against the defendant in a why that would
make the founders spin in their graves. Asking for all of the
information, all of it, is the least that can be done for the
defendants.
