The Courts worked...

... but at least one legislature malfunctioned.

Tests results should, I think, be disqualified as evidence if the device is improperly set or maintained. And that's what Courts have done.

But the story about the Washington State legislature disallowing evidence that the breathalyzer was faulty would, if true, be faulty.
I inserted "if true" because it's hard to believe that a rudimentary sense of justice would allow such a decision. If there is such a law, I hope the Courts invalidate it promptly.

But nowhere was there any interest in the software in the device. As I argued, testing of the devices and a comparison of specifications to actual condition would be enough.
