There's no double taxation here
While it would behoove us to read the actual decision rather than rely on an Internet based report (you'd be amazed at how nearly all the media got the Kelo v New London decision on eminent domain completely wrong), there's no double taxation here and the decision makes a lot of sense. The employer is in New York where there's a state income tax. Now many employees spend a great deal of their time traveling around the country -- they're working outside New York. Should their income be excempt from New York's state income tax? Of course not. Should their income be taxed by how much they make while in each state? Of course not? Should their income be taxed by where their employer's office is and where they'd be sitting at a desk if they didn't travel --- or in this case, telecommute? Of course it should. The court got it right according to the law.
