Sometimes litigation is what it seems to take
Too often Apple and other companies stonewall the consumer in
the face of obvious product flaws, and don't offer any consistent
fix even after consumers complain loudly, so the company often
brings litigation upon itself this way. All the company has to do,
is to admit a problem more quickly, but their stupid lawyers
have the company officers convinced that if the company admits
to a problem, that this admission will open them up to more
financial obligations for redress than would otherwise be the
case. This may be true in some cases, but not as many cases as
the lawyers think. The lawyers also aren't that concerned with
the impact on a company's reputation caused by stonewalling,
and how that impacts the company's bottom line, since lawyers
aren't involved in the less tangible, more speculative customer
relations end of things--their job is to see things only from the
shortsighted position of what it might cost a company to provide
redress.

However, it's been a pretty short span of time between the
release of the nano, and the litigation against its scratchy
screen, shorter than normal. It hasn't given Apple the time it
usually needs to first go through their obligatory stonewall act,
and then to finally agree to some sort of remedy. I guess a lot
of people just didn't feel like they had to be compelled to spend
a lot of effort this time trying to get Apple again to do at least
something.

Companies shouldn't hide behind the fact that some of the
production runs of a given product are fine, and point to those
properly-manufactured ones as some sort of "proof" that the
people with the improperly-manufactured ones are off their
rocker. Nor should Apple try to hide behind statements like the
material used to make the clear plastic covering the display, is
the same material used to make previous iPod models that don't
scratch as easily, if in fact the real problem is not the plastic
that's being used, but rather the resin coating on that plastic. I
don't really know what the problem is, but it sounds like that's
what's going on.

And the argument that if you don't want a music player with a
scratchy screen, then don't buy a nano, is a dumb one, because
there was nothing in the nano's advertising about the screens
being easily scratched. Most of the people complaining about
the scratched screens were early adopters--they couldn't be
expected to be psychic as to what would happen after
purchasing a nano. Maybe fewer people are buying nanos now,
for the time being, until this problem is addressed, but it's likely
there are plenty of people who are thinking of buying a nano,
who don't know about this problem--after all, you can't expect
everyone to be newshounds about every product they're about
to buy.
