What puzzles me (and perhaps irritates me a bit) about this situation is that litigation seems almost the first and only consideration for action in the US when such situations begin to emerge.

There may be better ways to approach this, but as one person noted, big companies don't readily admit to things even though they will go about offering rememdies. And perhaps there are few real options for holding a big companies "feet to the fire". However, consumer anger can be a devestating reality if it grows and becomes an influence on a producers bottom line, though Mac users I would suggest have that sort of affinity for the old "love me/abuse me" which may leave them less open to that. Still for me the crass practical reality rests on, is apple making efforts to remedy this situation? If so...litigation is likely a counter productive effort in the larger scheme of guarding against poor quality devices.

More litigation usually means more insurance, litigation and coverage costs etc..spread out over all the related consumer base. Avoiding it is good if possible. There seems a whole "shoot first, ask questions later mentality" sometimes.

The lawyers (and insurers) are the major winners in a long term sense, if they are getting a cut that is and its not gratis. Heaven forbid a free clas action suit (at least the lawyers in my family would shudder at the gratis prospect .

I just remember what my pappy told me long ago.
"Son! Never ever buy the first iteration of a data processing unit and always check the inside of the machine for moths"

In other words "buyer beware". This maxum remains as true today as when it was first uttered. Hardly satisfying but essentially true even with litigation as an avenue.

This is pretty small stuff though compared to the firestone tire fiasco several years ago...which involved the loss of several lives if I remember correctly. I always hated when my mother told me to get some perspective . Good luck nano owners who have this problem.

Just some thoughts.
