I find this rather humorous and enlightening
Previously big business saw patents as a way to lock up their corner of the market, and as a way to have playing chips to trade among each other. Only recently have big business in the US seen patents (not just software patents) as a double edged sword. When a smaller company, individual or patent trust have patents, they have nothing to lose by wielding like a sword in a bank.
"Give us money or else"
While I think truly innovative inventions should be protected (notice I said inventions and not ideas), the problem is that patents are now becoming a commodity by themselves, trading back and forth for money.
People try to patent absurdly obvious and non-innovative ideas, without ever actually creating them, in the hope of cashing in on it later.
(I'm curious if anyone has patented a light saber yet).
