First, let me say that I've never used BattleNet, although I have played some of the component games in LAN settings.

Blizzard's primary concern, at least in the legal paperwork, is the lack of authentication. Blizzard could set up something akin to a RADIUS server and let third parties authenticate clients against Blizzard before letting the clients on.

Blizzard could easily automate a system of checking for authentication by bouncing legitimate and illegitimate requests from various points on the Internet.

There is no need for Blizzard to provide this service for free. Since BattleNet has the capability of delivering ads and tracking subscribers, there is no reason to expect that licensees couldn't pay to host Blizzard's games. They can choose to pay thru ad revenue or paid subscriptions.
