A lot of ifs, as long as they didn't identify themselves as Blizzard, then they would be safe. I haven't read the full opinion, but from what I have read here, it sounds more like they got caught for their method of reverse engineering. I do not know what the whole EULA says, however, have you ever been able to return a piece of software to where you purchased it after you've opened the box, let alone the disk? They typically charge you at least a restocking fee.
