I kinda thought the same thing, but I read the judgement from the court. There was far more to the situation than what ZDNet reported.
Frankly, I can't see where anyone who is an honest proponent of open source and the protection of copyright shouldn't be condeming these guys. First they reverse engineered protocols after agreeing not to by accepting the EULA's - then they ripped at least one game apart to take a peek at the internals so that they could emulate the on-line ad popups that happen in Battlenet. They also reverse engineered how Battlenet receives the CD Key hash algorithm, and return an Okay code back.
Then these guys released the project as open source. Problem is - the work is derived from a major violation of both copyrighted works AND is in violation of the DMCA. Further both programmers were well aware that pirated copies of Blizzard games could be, would be, and were played on their services - and were aware of this BEFORE they released their code as open source.
