If there IS prior art.. find it...
Find Prior Art, Send to Interested Parties and the magic begins...

It's not hard to challenge a patent, it is invalidated [not revoked] and an investigation begins to see if the patent is truly valid or if prior art invalidates and revokes the patent.

If there is prior art, and no provisional application [which can be up to one year prior to the application], then patenting the technology is not possible.

Patents are NOT hard and fast rules that cannot be challenge. And ANYONE can challenge a patent.
